واکاوی تجارب زیسته کارکنان نظام بانکی از قانون‌گریزی خیرخواهانه: یک مطالعه پدیدارشناختی در مدیریت شعب بانک مسکن خراسان رضوی

چکیده

هدف پژوهش حاضر واکاوی تجارب زیسته کارکنان و مدیران بانک مسکن خراسان رضوی از قانون‌گریزی خیرخواهانه و تبیین ماهیت، زمینه‌ها، فرایندها و پیامدهای ادراک‌شده این پدیده در محیط بانکی بود. این پژوهش با رویکرد کیفی و استراتژی پدیدارشناسی تفسیری انجام شد. مشارکت‌کنندگان شامل 14 نفر از کارکنان و مدیران صف شعب بانک مسکن بودند که با استفاده از نمونه‌گیری هدفمند ملاک‌محور و گلوله‌برفی انتخاب شدند. داده‌ها از طریق مصاحبه‌های عمیق و نیمه‌ساختاریافته تا دستیابی به اشباع گردآوری و با روش هفت‌مرحله‌ای کلایزی تحلیل شدند. اعتبار یافته‌ها نیز بر اساس معیارهای گوبا و لینکلن شامل اعتبارپذیری، انتقال‌پذیری، اطمینان‌بخشی و تأییدپذیری ارزیابی شد. تحلیل تجارب مشارکت‌کنندگان به شناسایی پنج مقوله اصلی و 18 مؤلفه منجر شد. قانون‌گریزی خیرخواهانه از تعامل «محرک‌های انگیزشی» شامل کمک به مشتری، افزایش بهره‌وری سازمانی، حمایت از همکاران و حفظ منافع و اعتبار سازمان با «آمادگی کنشگری» شامل همدلی، مالکیت اخلاقی و هویت حرفه‌ای شکل می‌گیرد. قوانین بروکراتیک، فوریت و فشار زمانی، ابهام مقررات و فشارها و تعاملات اجتماعی نیز بستر وقوع این رفتار را فراهم می‌کنند. کارکنان در فرایند قانون‌گریزی از سازوکارهای خنثی‌سازی، مدیریت تضاد نقش، ارزیابی ریسک و تفسیر مصلحت‌جویانه استفاده می‌کنند تا فاصله میان الزامات رسمی و مقتضیات انسانی و سازمانی را مدیریت کنند. پیامدهای این رفتار ماهیتی دوگانه داشت؛ افزایش سرمایه اجتماعی، اعتماد و رضایت درونی در کنار فرسایش روانی، اضطراب و ترس از نظارت تجربه می‌شد. قانون‌گریزی خیرخواهانه در محیط بانکی صرفاً یک تخلف سازمانی نیست، بلکه می‌تواند به‌عنوان راهبردی انطباقی برای مدیریت تعارض میان مقررات صلب و مسئولیت‌های انسانی و حرفه‌ای کارکنان ظاهر شود؛ بنابراین، ایجاد انعطاف قانونمند، تقویت اختیار مدیریتی کنترل‌شده و بازنگری در سازوکارهای نظارتی می‌تواند از تبدیل کنشگری خیرخواهانه به تخلف پنهان جلوگیری کند.
